In accordance with Regulation 19.5.6 I inform you of the following decision reached by a panel of the ISAF Review Board after a hearing on 27 and 28 October in Southampton:

ISAF Eligibility Marc Pickel (GER)

In accordance with Regulation 19.5.6 I inform you of the following decision reached by a panel of the ISAF Review Board after a hearing on 27 and 28 October in Southampton:

DECISION

Racing Rule 69 applied to the German sailors at the athletes' party in Sydney on the 28th of September 2000.

The Panel finds no reason not to accept the DSV's findings in general including that Michael Fellmann was struck by Marc Pickel during the party and that constituted a gross breach of good manners and conduct that brought the sport into disrepute under RRS 69.

Both parties submitted to the Panel that the suspension of ISAF eligibility be lifted as of the date of the Panel's ruling. However, in the light of the evidence, the Panel confirms the suspension of Marc Pickel's ISAF eligibility until 31st December 2001.

The scope of the suspension of eligibility is provided by the ISAF Eligibility Code as it was at the time of the incident in Sydney, namely Appendix K of the Racing Rules of Sailing 1997- 2000.
